When the gutters are in need of repair at a condominium complex, who should be responsible for all of the water damage that they cause?
The Deauville Condominium Association hired Anderson roofing to replace gutters in the complex. The roofing company had removed some of the older gutters and hadn’t gotten around to installing the new ones when a couple of rainstorms hit last summer. Five condo owners say that their homes suffered water damage because there were no gutters.
Nancy McCalpin, condo owner said, “It’s completely unfair that they want us to pay for our own damages because we didn’t take the gutters down.”
Shelley Maldonado, condo owner said, “We shouldn’t be stuck with it at all. We did nothing, there was no way we could protect ourselves after those gutters came down.”
Patricia Colvard, another condo owner said, “It’s raining inside. It’s very upsetting especially because here could be mold in the walls and with the COVID-19 going around that’s respiratory that could just compound issues. “
Anderson Roofing did contact its insurance company, Encova, which had an engineer inspect the issue. The insurance company then denied the claim saying; “We don’t find any negligence or liability on the part of our insured for damages.”
The damage was blamed on windows with cracks and rotten wood as the reason the water entered the condo units. The five owners say that individual damages ranged from $2,000 to $12,000.
Mary Jo Orth, a Deauville Condo Association board member said, “It wasn’t fair because it was so obvious that without gutters rain is going to come into the building.”
